Terms of Service

1. Identification and scope

Hayley Clark is an independent Discord bot offering moderation, utility, automation, economy, entertainment, and server-management features. “Services” means the bot, this website, the official support server, and associated features. Hayley Clark is not affiliated with, sponsored by, or endorsed by Discord.

Specific features, such as the virtual economy, are also governed by the Economy Terms. If provisions conflict, the specific provision prevails only for the matter it governs, always subject to applicable law.

2. Eligibility and acceptance

You must meet the minimum age required by Discord and the laws of your country. Where parental or guardian authorization is legally required, use is permitted only with that authorization. Anyone installing or configuring the bot for a server represents that they have sufficient permission to do so.

3. Permitted use and user responsibilities

When using the Services, you agree to:

• comply with applicable law, these Terms, and Discord's terms, policies, and Community Guidelines;
• correctly configure roles, channels, and permissions, granting the bot only necessary access;
• supervise people authorized to use administrative commands and review relevant automated actions;
• respect third-party rights, including privacy, image, reputation, and intellectual property;
• keep your account secure and promptly report suspected fraud, failures, or unauthorized access.

4. Prohibited conduct

You may not use the Services to:

• create, store, distribute, or facilitate illegal, sexually explicit (NSFW), abusive, discriminatory, threatening, or child-exploitative content;
• commit scams or harassment, distribute malware, obtain unauthorized access, or violate third-party rights;
• send spam, abusively automate commands, exceed limits, overload, or destabilize the Services;
• exploit, conceal, or encourage bugs and vulnerabilities, manipulate systems, or obtain unfair advantages;
• copy, modify, reverse engineer, or bypass technical measures unless expressly allowed by law;
• impersonate Hayley Clark, team members, or official representatives.

5. Moderation, suspension, and termination

Depending on severity and available evidence, violations may result in warnings, removal of content or benefits, reversal of virtual transactions, command restrictions, user or server blocks, and bans from the official server. Immediate measures may be taken to protect users, third parties, or Service security. Where reasonable, review requests may be submitted through the contact channel.

You may stop using the Services at any time by removing the bot and revoking the Discord application authorization. Obligations that by their nature survive termination remain effective.

6. Third-party content, links, and services

User content, giveaways, loans, trades, events, and prizes organized by third parties are the responsibility of their authors or organizers. The team may respond to reports or evidence of fraud but does not guarantee or mediate those activities.

The Services depend on or may display content from external platforms such as Discord and payment providers. Those services have their own rules, privacy practices, and availability. A link does not constitute endorsement. Always verify the destination before providing information.

7. Paid plans, payments, and refunds

Before a real-money purchase, the applicable plan, period, price, and benefits will be shown. Payment may be processed by an external provider. Virtual-currency and real-money purchases are distinct and are also subject to the Economy Terms.

Cancellation or refund requests will be reviewed according to the offer, payment method, and applicable law, including mandatory consumer rights. Nothing in these Terms excludes any warranty, liability, or right that cannot legally be waived. Suspected fraud, chargebacks, or improper charges may lead to precautionary suspension of the benefit while the case is reviewed.

8. Privacy, data, and security

To operate, the Services may process Discord user and server identifiers, settings, virtual balances and items, command-use data, technical logs, and information needed for support, moderation, and security. Messages or portions of messages should be processed only when an enabled feature depends on that content, such as XP, automation, or moderation.

Data may be processed by providers necessary for hosting, databases, authentication, storage, and payments, and disclosed when required by law or a valid authority request. We use reasonable security measures, but no system is completely immune to incidents. Hayley Clark never asks for your Discord password or token.

Details about purposes, legal grounds, retention, sharing, and data-subject rights are in the Privacy Policy. Access, correction, or deletion requests may be submitted through the channel in section 13, subject to legal retention requirements and technical limitations.

9. Service availability and changes

The Services are provided as available and may experience outages, delays, or failures. Features may be corrected, updated, replaced, or discontinued for technical, security, legal, or operational reasons. When possible, relevant changes that adversely affect active paid plans will be communicated with reasonable advance notice.

10. Limitation of liability

To the fullest extent permitted by law, the team is not liable for damage caused by incorrectly configured permissions, misuse by users or administrators, third-party content and transactions, failures by Discord or other providers, or events outside its reasonable control. Administrators remain responsible for reviewing permissions, records, and important server decisions.

This clause does not exclude liability for intentional misconduct, gross negligence, a security failure attributable to the team, violation of consumer rights, or any situation where exclusion is prohibited by law.

11. Intellectual property

The Hayley Clark name, visual identity, code, texts, and other original elements are protected by applicable law. Using the Services does not transfer those rights. Third-party trademarks and content belong to their respective owners.

12. Changes to these Terms and general provisions

These Terms may be updated to reflect legal, technical, or operational changes. The date at the top will be changed and reasonable efforts will be made to communicate material changes before they take effect. If you disagree with a new version, you must stop using the Services.

If any provision is invalid, the remaining provisions remain effective. Tolerating a breach is not a waiver of rights. These Terms are governed by the laws of the Federative Republic of Brazil, without excluding mandatory user protections or the right to seek the legally competent authorities and courts.

13. Contact

Questions, reports, review requests, and data-related requests may be submitted through the official Hayley Clark server. Never send passwords, tokens, or other secrets through support.
